JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-10-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Laukahi P.S. Case No. 110 of 2014 registered for the offence punishable under sections 456, 457, 376 and 511 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the present case has been filed after delay of about twelve days without any explanation. The daughter of the informant had plucked some mangoes from the Orchard of the petitioner to which the petitioner had objected, and only due to that the present false case has been lodged. There is no medical report on the record. During investigation also, nothing has come against this petitioner. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner,

Patna High Court Cr.Misc. No.37847 of 2017(4) dt.09-10-2017 2/2 above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jhanjharpur in connection with Laukahi P.S. Case No. 110 of 2014 subject to the conditions laid down under section 438(2) Cr.P.C.
