The petitioner apprehends arrest in connection with Town P.S. Case No. 01 of 2018 registered for the offence punishable under section 120 (B) of the Indian Penal Code and 25 (1-b)/26/ 35 of the Arms Act.
It has been submitted that the informant, who happens to be Police Officer, apprehended one Lal Saheb @ Tarun and in course of interrogation, he disclosed that he supplied fire arms to this petitioner, but nothing has been recovered either from the possession of the petitioner nor there is any specific allegation against him except the disclosure of his name by the co-accused. Considering the facts and circumstances of the case, the prayer for anticipatory bail of the petitioner is allowed and he, in the event of arrest or surrender before the court below within a period of six weeks, be enlarge on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in connection with Town P.S. Case No. 01 of 2018, subject to the condition as laid down under section 438 (2) of the Criminal Procedure Code. Further condition is that
(1) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. (2) The petitioner will not induce any witness or tamper with the evidence. (3) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
