The petitioner seeks bail in connection with Phulparas P.S. Case No. 488 of 2019 registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present bail application has been filed in terms of the liberty granted to the petitioner by order dated 04.01.2023 in Criminal Miscellaneous No. 53977 of 2022 by which his bail application was rejected earlier.

The learned counsel for the petitioner next submits that the charges against the petitioner stand framed by order dated 02.02.2023, as would be evident from Annexure-3 to the

Patna High Court CR. MISC. No.27101 of 2023(2) dt.03-05-2023 2/2 bail application.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submission made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Phulparas P.S. Case No. 488 of 2019.

One of the bailors of the petitioner shall be his father Vinod Baitha.

Further, in the event, if the learned Trial Court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned Trial Court shall forthwith cancel his bail bonds after recording reasons and shall take all coercive steps to ensure that petitioner is behind bars.
