JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Bihar P.S. Case no. 209 of 2017, registered under Section 414 of the Indian Penal Code.

The accusation is that on receiving secret informant regarding theft of one motorcycle by two persons and coming of them towards Naisari, the informant and other Police personnel started checking of the vehicle and two persons were seen in suspicion condition moving on the motorcycle. On seeing the Police personnel they started fleeing after leaving the motorcycle. On chase, one person was apprehended, who disclosed the name of petitioner as his associate succeeded to flee away saying that petitioner used to commit theft of the motorcycle and he used to sell the same.

No.48428 of 2017 (2) dt.16-10-2017 2/2 Learned counsel for the petitioner submits that petitioner has no criminal antecedent and due to ulterior motive, the Police got implicated the petitioner in the present case showing his involvement in the present case only on the confessional statement of co-accused. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 209 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
