The petitioner seeks bail in a case registered under Sections 354(A) of the Indian Penal Code and 37(c) of Bihar Prohibition and Excise Act, 2016 and 8 of POCSO Act. Allegation is that the petitioner tried to commit rape upon the daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to village politics. The allegation of

Patna High Court CR. MISC. No.24019 of 2019(4) dt.01-07-2019 2/2 attempt to rape is denied by the petitioner. He has remained in custody for about six months.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act, Bhagalpur in connection with Kajraili P.S. case No.09 of 2019, G.R. No.62 of 2019.
