JUSTICE SANJAY PRIYA ORAL ORDER 03-11-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Paroo P.S. Case No. 97 of 2017 instituted for the offence under Sections 302, 34 and 120(B) of the Indian Penal Code.

It has been submitted on behalf of the informant that regular bail of co-accused Ranjan Kumar @ Ranjan Kumar Singh, with similar allegation has been rejected by a coordinate Bench of this Court vide order dated 21.09.2017 passed in Cr. Misc. 42218 of 2017.

Case diary has been received wherein the postmortem report of the deceased is available.

Learned A.P.P. after perusing the post mortem report has submitted that the Doctor has found six injuries on the person

Patna High Court Cr.Misc. No.45701 of 2017 (3) dt.03-11-2017 2/2 of the deceased caused by sharp cutting weapon and cause of death was opined on account of those injuries. In the written report there is allegation that this petitioner along with other accused caught hold the brother of the informant and gave several knife (Chhura) blow on different parts of the body and he found his brother dead and his head was slit.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered by the court below in accordance with law without being prejudiced by this order.
