JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-10-2020 In view of the submission and undertaking of the learned counsel for the petitioners, at the time of hearing of this application through Video Conferencing, that he would remove the defect(s), as pointed out by the stamp reporter, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.
Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Siwan Town P.S. Case No. 64 of 2020 registered under Section 382/34 of the Indian Penal Code.
The accusation is that in the evening of 08.02.2018, informant, Raja Sah, was returning to his house after supply the meal to his father, talking from his mobile. In the meantime, two persons
Patna High Court CR. MISC. No.25763 of 2020(2) dt.13-10-2020 2/2 came on motorcycle from behind, out of them, one snatched his mobile. Thereafter, the informant made attempt to caught hold but one person, who was sitting on rear sit, succeeded to flee away while the person, who was driving the said motorcycle, was caught hold who disclosed his name as Aklak Ali @ Akhlakh Ali (petitioner) and the snatched mobile was also found from his possession. On query, he also disclosed the name of another person as Asfaque, who succeeded to flee away.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case mere on suspicion. Further submission is that petitioner has no criminal antecedent and is in custody since 08.02.2020.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Siwan, in connection with Siwan Town P.S. Case No. 64 of 2020. Out of two sureties, one surety must be the close relative of the petitioner.
