The petitioner is apprehending his arrest in connection with Bettiah Town (Kalibag) P.S. Case No. 165 of 2017 registered for offences punishable under Sections 379, 411/34 of the Indian Penal Code.
Petitioner is not named in the first information report. His name has transpired later on, on the confession of the coaccused. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, in my opinion, this is not a fit case for grant of anticipatory bail. However, petitioner may surrender before the Court below within a period of four weeks and make
Patna High Court Cr.Misc. No.36500 of 2017 (2) dt.10-08-2017 2/2 prayer for regular bail, which will be disposed of on its own merit, if possible on the same day, considering the submissions of the learned counsel for the petitioner that except suspicion there is nothing against the petitioner and also other materials available on record, without being prejudiced by the order of this Court. With the aforesaid observation, this application is disposed of.
