Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Matiyariya P.S. Case No. 51 of 2021 registered on 09.07.2021 lodged under Sections 304(B), 201 and 34 of the I.P.C. As per the prosecution case, F.I.R. has been lodged against four named accused persons, including the present petitioner. The allegation made in the F.I.R. is that, as per the informant, his daughter was killed by the petitioner along with his family members.
Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further
Patna High Court CR. MISC. No.29197 of 2023(2) dt.07-06-2023 2/2 submits that petitioner is in custody since 25.07.2021. Counsel submits that petitioner is the victim in this case and he is in custody for about two years.
Learned counsel for the State opposes the prayer for bail and it is a case under Section 304(B) of the Indian Penal Code and petitioner is the husband.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.
With this observation, the bail application stands rejected.
Trial court is directed to expedite the trial within nine months from today.
