ANJANA MISHRA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Madhubani Mahila P.S. Case No. 29 of 2016 for the offences registered under Sections 341, 323, 304 and 376/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that no specific allegation has been made against this petitioner, father of the main accused. It is further submitted that the co-accused, namely, Md. Aslam @ Bhutan has also been granted anticipatory in Cr. Misc. No. 38082 of 2016 vide order dated 26.09.2016.
Considering the aforesaid facts and circumstances of the
Patna High Court Cr.Misc. No.41530 of 2016 (3) dt.11-01-2017 case and that the victim girl also does no indicate that the petitioner had played any role, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub- Divisional Judicial Magistrate, Madhubani, in connection with Madhubani Mahila P.S. Case No. 29 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) Jagdish/- U T
