JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-09-2017 Heard leaned counsel for the petitioner and the leaned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 74 of 2017, registered under Section 307 of the Indian Penal Code and 27 of the Arms Act, pending in the court of the A.C.J.M-1, Danapur.

The accusation is that informant Ankit Kumar had gone at the house of the petitioner to attend the birthday function of his daughter, where petitioner fired in air through his gun in which the bullet hit in the wall and caused injury at the hand of the informant.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not

Patna High Court Cr.Misc. No.42352 of 2017 (2) dt.19-09-2017 2/2 inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
