ANJANA MISHRA ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the Block Co-operative Extension Officer, is apprehending his arrest in connection with Bahadurganj P.S. Case No.128 of 2015 for allegedly having committed the offence under Sections 193, 166A, 420, 466, 465/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that as a Block Co-operative Extension Officer he has no role to play in the issuance of caste certificate and the same is issued on the basis of the recommendation of the concerned Revenue Karmarchari to the Block Development Officer and the petitioner is only a via media through which the file moves. He

Patna High Court Cr.Misc. No.54095 of 2015 (3) dt.14-12-2015 2/2 submits that since he is only the via media of the two authorities-one is making the recommendation and another issuing the certificate- he has no role to play. Considering the submissions made by the petitioner and the nature of allegations made in the F.I.R., let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj, in connection with Bahadurganj P.S. Case No.128 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
