JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-10-2020 Heard Mr. Vikash Kumar Pankaj, learned counsel for the petitioner and Mr. Mritunjay Kumar Nirala, learned Additional Public Prosecutor for the State.
The petitioner is apprehending arrest in connection with Pipra P.S. Case No. 434 of 2019 for the offences under Sections 25(1-b)a, 26 and 35 of the Arms Act. Considering the fact that petitioner is not a man of unimpeachable character as he is also accused in Pipra P.S. Case No. 429 of 2019, the Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer is, accordingly, rejected.
However, the court below is directed to dispose of the application of the petitioner for regular bail on surrender on the same day on its own merit without being prejudiced by the refusal of anticipatory bail to the petitioner by this Court. (Anil Kumar Upadhyay, J) spandey/- U T
