C.W.J.C. No. 11522 of 2011 was earlier dismissed for non-prosecution. Later on, it was restored vide order dated 14.12.2013 in MJC No. 4417 of 2011. C.W.J.C. No. 13167 of 2011 was dismissed as withdrawn vide order dated 14.7.2014 and interim order dated 26.8.2011 was vacated. Since both the writ applications were heard together

Patna High Court CWJC No.11522 of 2011(4) dt.29-07-2019 2/3 and on 26.8.2011 order was passed in both the writ applications, it would be appropriate to dispose of the present application in the light of the order dated 14.7.2014 in C.W.J.C. No. 13167 of 2011 and as such it is disposed of in terms of order dated 14.7.2014 in C.W.J.C. No. 13167 which is quoted below:- "Heard learned counsel for the petitioner, learned counsel for the respondent no.9 as well as learned counsel appearing on behalf of the State.

By the impugned order, the District Teacher Employment Appellate Tribunal has cancelled the appointment of some of the Panchayat Teachers including the present petitioner on the ground that persons with superior merit were ignored. The tribunal has ordered for fresh counselling during which the parties shall have equal opportunity of participation.

Learned counsel for the petitioner seeks permission to withdraw this application in the facts and circumstances of the case as all the eligible persons have been allowed to participate in the counselling process.

This application is accordingly dismissed as withdrawn.

The Court expects that the process of counselling shall be completed within two months
