The petitioner seeks bail in Parbatta P.S. Case No. 385 of 2020, registered for the offence punishable under Sections 25(1-b)a, 26(i) of the Arms Act.
As per the prosecution case, during investigation of Parbatta PS Case No. 39 of 2020 it was revealed that informant if this case Pawan Kumar (present petitioner) assaulted Shailesh Kumar Nisad after tieing his hands and legs and thereafter falsely been implicated accused Shailesh Kumar Nisad and his brother Manjeet Kumar Nishad by planting country made pistol and cartridge in the pocket of Shailesh Kumar Nishad. Manjeet was not present at the place of occurrence.
It is submitted on behalf of the petitioner that no arms and ammunitions have been recovered from possession of this
Patna High Court CR. MISC. No.35940 of 2021(2) dt.09-12-2021 2/2 petitioner and has falsely been implicated in this case by the police. Petitioner claims clean antecedent and he is in custody since 08.02.2021. Investigation is complete.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Khagaria in connection with Parbatta P.S. Case No. 385 of 2020.
