Petitioners apprehend their arrest in connection with Kurtha P.S.Case No. 89 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 379, 324, 504, 506 and 307/34 of the Indian Penal Code.

Allegation against petitioner No.1 is of assault to the informant causing injury to his finger and there is general and omnibus allegation against petitioner No.2.

Submission of learned counsel for the petitioners is that police finding the case not true has submitted final form, however learned Magistrate has taken cognizance of the offence differing with the opinion of police.

No.11010 of 2018 (3) dt.03-04-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal, in connection with Kurtha P.S.Case No. 89 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners shall co-operate in investigation and appear before the Investigating Officer as and when required, except on genuine ground, failing which their bail bonds shall be cancelled.
