The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 504, 506/34 of the Indian Penal Code. Accusation is of constructing house by encroaching the land of the informant. On protest being made, the accused persons assaulted the informant. It is submitted by the learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the accusation in the background of civil nature of dispute, let the above named petitioner be

Patna High Court Cr.Misc. No.55858 of 2015 (2) dt.09-12-2015 released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri S.K. Sharma, Judicial Magistrate, Ist Class, Katihar in connection with Barsoi P.S. Case No. 202 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
