Petitioner seeks bail in connection Sikraul P.S. Case no. 18 of 2021 registered for the offence punishable under sections 363, 366A, 420 and 120B of the Indian Penal Code. Learned senior counsel for the petitioner submits that petitioner is not named in the first information report and his name transpired in the statement of the victim recorded under section 164 Cr.P.C where also nothing specific has been alleged again him nor victim has stated anything against the petitioner. Learned senior counsel for the petitioner further submits that Sonbala Kumari, Ragni Kumari and Kriti Kumari daughters of Nand Kumar Pandey were instrumental in kidnapping the daughter of the informant. Patna High Court CR. MISC. No.36099 of 2021(2) dt.06-12-2021 2/2 petitioner next submits that the aforesaid three named accused were granted bail vide order dated 21.10.2021 in Cr. Misc. no. 33479/2021.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody and charge sheet has been submitted and is a person with clean antecedent and FIR named accused have been granted bail, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge VIcum- Special Judge, POCSO Act, Buxar in Sikraul P.S. Case no. 18 of 2021.
