JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-02-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Parsa Bazar Police Station Case No. 86 of 2015, disclosing offences under Section 304B/34 of the Indian Penal Code.

Two submissions have been advanced on behalf of the petitioner. It is firstly contended that the marriage between Sudhir singh and the deceased was solemnized more than seven years before the date of occurrence and, therefore, no offence under Section 304B of the Indian Penal Code is made out. It has, secondly, been submitted that the petitioner is distantly related to the husband of the deceased and, therefore, he has been falsely implicated in

Patna High Court Cr.Misc. No.56961 of 2015 (3) dt.26-02-2016 2/2 the present case. It has also been submitted that one of the co-accused, Sujit Singh, has been granted anticipatory bail by this Court by order dated 12.01.2016, passed in Criminal Misc. No. 951 of 2016.

Considering the aforesaid submissions, this application is allowed.

Let the petitioner, Satendra Singh, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Atul Sinha, learned Judicial Magistrate, 1st Class, Patna, in connection with Parsa Bazar Police Station Case No. 86 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
