JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-09-2020 Heard learned counsel appearing on behalf of the petitioner, learned counsel appearing on behalf of the Bihar School Examination Board as well as learned counsel for the State on the original writ petition as well as interlocutory application being I.A. No. 01 of 2020.

It is admitted position that the respondent-Board has accepted fees and forms of the students of the petitioner-college. The only grievance of the petitioner that now remains

If it is peculiar facts and circumstances of the case, then fees and forms was accepted by the Bihar School Examination Board, the Court is not inclined to issue any positive order in favour of the petitioner. However, liberty is granted to the petitioner to approach the Chairman/Secretary of the Bihar School Examination Board who shall consider the case of the petitioner-college for condonation of late fine and pass appropriate order considering the attending facts and circumstances during Covid pandemic within a period of two months from the date of receipt/production of a copy of this order.

With the aforesaid, the present writ petition stands disposed of.
