The petitioner is apprehending arrest in connection with Bihta P.S. Case No. 287 of 2020 for the offences under Sections 114, 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code pending in the Court of ACJM-I, Danapur, Patna.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner has been falsely implicated in this case due to political rivalry.

Considering the fact that the petitioner is also accused

Patna High Court CR. MISC. No.22929 of 2020(3) dt.07-10-2020 2/2 in two other cases, the Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer is, accordingly, rejected.

The plea of false implication on account of political rivalry can be raised before the court below at the time of consideration of application for regular bail and the Court below shall consider and dispose of the application for regular bail on surrender of the petitioner on the same day without being prejudiced by the refusal of anticipatory bail by this Court.
