Public Prosecutor as well as Sri Ajay Kumar Gautam, learned counsel for Opp.Party no.2/Bihar State Electricity Board.

The petitioner, who is owner of flour mill as well oil mill , has approached this Court for grant of anticipatory bail in Belaganj P.S. Case No.158 of 2016 registered for the offence under Section 135 of the Electricity Act.

Sri Ajay Kumar Gautam, learned counsel appearing on behalf of Opp.Party no.2, at the very outset, submitted that the offence, as alleged, is compoundable offence and this petition can be disposed of asking the petitioner to approach the competent court for compounding the offence.

Accordingly, there is no reason to extend the

Patna High Court Cr.Misc. No.46427 of 2016 (3) dt.05-12-2016 2/2 privilege of anticipatory bail. However, it is observed that if the petitioner appears before the court below and makes a prayer for regular bail with a petition for compounding the offence within six weeks from today, the learned court below may examine the same and pass appropriate order in accordance with law.
