JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 16-12-2016 After some argument, the learned counsel appearing on behalf of the petitioner, in presence of the learned G.P. 3, appearing on behalf of the respondent nos. 1 to 4, seeks permission to withdraw the present writ petition with a liberty to approach the prescribed appellate authority under the provisions of The Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1961 for grant of appropriate relief to the petitioner with respect to the lands claimed by her as also the order passed/ notification issued by the original authority.
Permission is accorded.
The writ petition stands disposed of as withdrawn with the liberty aforesaid.
If an appropriate appeal is filed on behalf of the petitioner before the prescribed appellate authority within a period of four weeks from today with a certified copy of the present order
Patna High Court CWJC No.14743 of 2007 (12) dt.16-12-2016 2/2 and if it is found to have become barred by limitation and if any petition is filed on behalf of the petitioner for condonation of such delay, then the learned prescribed appellate authority shall take into consideration that on a bonafide legal advice, the present writ petition was filed on 20.11.2007 and that remained pending before this Court till date.
