Petitioner seeks regular bail in connection with Pirpainti P.S. Case No. 56 of 2021 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Police on chase arrested the petitioner and recovered 26.82 liters of illicit liquor from the motorcycle, which was being driven by the petitioner.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and has falsely been implicated in this case by the Police with oblique motive. He next submits that petitioner is not the owner of the motorcycle in question and no illicit liquor has been recovered from his conscious possession or the vehicle belonging to him. He next submits that petitioner is in custody since 19-03-2021 and charge sheet has already been submitted.

No.35886 of 2021(3) dt.17-01-2022 2/2 Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 19/03/2021, charge sheet has already been submitted, trial is not likely to be concluded in near future due to COVID 19 pandemic and the petitioner has got no criminal antecedent, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- II cum Special Judge (Excise Act), Bhagalpur in connection with Pirpainti P.S. Case No. 56 of 2021.
