JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Paharpur P.S. Case no. 72 of 2016, registered under Sections 409, 420 of the Indian Penal Code.

The allegation of informant Chhote Lal Singh is that his name and name of his brother are at Sl. No. 32 and 42 in APL list of the village, both handed over the application with land owner certificate for compensation of damage of crop through the petitioner, who is Agricultural Advisor, but he being the Agricultural Advisor showed the less land against their name due to that reasons, both got less compensation. Whereas, he enhanced the area of land in respect to his family got more compensation.

No.47121 of 2016 (3) dt.20-01-2017 2/2 Learned counsel for the petitioner submits that, in fact, due to village dirty politics petitioner has falsely been implicated in this case. Moreover, it would appear from para 57 and 58 of the case diary that both the witnesses, who are co-villagers have stated that they have obtained the compensation of damage of the crop property without giving any commission to any one. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari in connection with Paharpur P.S. Case No. 72 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
