JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-09-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Though, the present writ petition has been filed seeking quashing of the order dated 23.01.2018, passed by the Sub Divisional Officer, Triveniganj to the extent it has been observed that on account of coming into force of the Bihar Targeted Public Distribution (Control) Order, 2016, the petitioner was required to deposit the necessary fees and get his

Patna High Court CWJC No.10858 of 2021(2) dt.13-09-2021 2/2 license converted into one under the New Bihar Targeted Public Distribution System (Control) Order, 2016 but since he did not deposit the fees in time, his license bearing License no. 9 of 1992 has stood cancelled, nonetheless, the learned counsel for the petitioner seeks liberty to file appropriate appeal before the District Magistrate, Supaul.

The learned counsel for the respondent State Sri Upendra Pratap Singh (AC to SC 4) has got no objection. Accordingly, the present writ petition stands disposed of with liberty to the petitioner to file appropriate appeal before the District Magistrate, Supaul and in case, such an appeal is filed within a period of four weeks from today, the same shall be decided on merits by a reasoned and a speaking order in accordance with law, within a period of eight weeks, thereafter, considering the fact that though the petitioner has deposited the requisite fees but the same has been deposited after the stipulated time frame.
