The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 201, 120(B), 34 of the Indian Penal Code.
As per the prosecution case, on 23.04.2021, the informant got an information that dead-body of his son is lying near a boring in village Nouranga and thereafter, when he reached there he came to know that all the F.I.R. named accused persons including this petitioner committed the murder of his son.
It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. Informant is not eyewitness of the occurrence and only on suspicion, petitioner has been made accused. Police, after investigation, found the case
Patna High Court CR. MISC. No.26305 of 2022(2) dt.20-09-2022 2/2 untrue against the petitioner. Similarly situated co-accused Sanjay Yadav has already been granted bail by this Court, vide order annexed at Annexure 3 to the petition. Petitioner has got clean antecedent.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bihar Sharif, Nalanda in connection with Bind P.S. Case No. 51 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
