The petitioner apprehends his arrest in connection with Giriyak P.S. Case No.245 of 2016 registered under Sections 420, 406 and 409 of the Indian Penal Code besides Section 66 of the I.T. Act.

The accusation is that on 10.10.2012, Saving Bank Account was opened in Madhya Bihar Gramin Bank, Pawapuri More Branch, in the name of Sanjay Kumar in which rate of interest was mentioned as 404% per annum in place of 4% per annum. Similarly, Saving Bank Account was opened in the name

Patna High Court Cr.Misc. No.39297 of 2017 (3) dt.12-12-2017 2/2 of Khushi Sinha in which Voter I.D. Card was forged and Rs.40,00,000/- was transferred on 30.07.2016. At that time, Sri Pramod Kumar Chaudhary was the Branch Manager, who was suspended. On verification, it was detected that there are lapses of five Bank Employees including the petitioner, Assistant of the said Branch.

Learned counsel for the petitioner submits that duty of the petitioner is only to make entry in the computer after permitting to open the account and he has no concern about verification and checking of the form of the opening of the Saving Bank Account. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sushil Prasad, Judicial Magistrate, First Class, Biharsharif, Nalanda, in connection with Giriyak P.S. Case No.245 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
