The petitioner apprehends her arrest in Teghra P.S. Case No. 80/2016, registered for the offences punishable under Sections 290, 272, 273 and 34 of the Indian Penal Code and Section 47(A) of the Excise Act.
The informant raided different places and from the house of the petitioner 18 bottles each containing 400 ml (seven litres) of country-made liquor was recovered. Learned counsel for the petitioner submits that very small quantity of country-made liquor was recovered. Petitioner is a lady, but it appears that anticipatory bail petition of Kanchan Devi has already been rejected vide order dated 30.06.2016 passed in Cr. Misc. 26652/2016.
Patna High Court Cr.Misc. No.45809 of 2016 (3) dt.05-12-2016 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders in the court below, learned court below shall consider the prayer for regular bail of the petitioner taking into consideration that only seven litres of country-made liquor is recovered from the house of the petitioner and dispose of the bail petition preferably on the same day.
