JUSTICE PARTHA SARTHY ORAL ORDER 20-10-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Alauli P.S. Case No. 33 of 2020 registered under section 392 of the Indian Penal Code. As per allegation in the FIR, the three named accused persons including the petitioner herein forcibly took away the motorcycle of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reasons, the motorcycle of the informant has been recovered from an open field situated near the mandir in the village. The petitioner has no criminal antecedent and is in custody since 6.2.2020. Investigation with respect to the

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and in view of the submissions made on behalf of the petitioner, recovery of the motorcycle, the petitioner having no criminal antecedent and being in custody since 6.2.2020, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Alouli P.S. Case No. 33 of 2020 on furnishing bail bond of Rs. 10,000/ (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.
