Petitioner is in custody in connection with Pocso Trial No. 126 of 2019 arising out of Hussainganj P.S. Case No. 134 of 2018 for the offence under sections 363, 366A of the Indian Penal Code and 6/8 of Pocso Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

Referring to the age of the victim learned counsel submits that pocso is not attracted in the instant case. He submits that statement of the victim is indicative of the fact that she has voluntarily accompanied the petitioner and married with the petitioner. The petitioner did not kidnap her.
