1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the complainant alleges that his land was not being mutated hence he discussed the issue with the petitioner who is his friend, further on his advice he signed on a non-judicial stamp paper of Rs. 1,000/- for preparing a family tree and gave it to the petitioner and later to his utter shock received a notice from the petitioner that he

No.26965 of 2023(2) dt.17-07-2023 2/3 had agreed to sell his land for an amount of Rs. 8,00,000/- out of which Rs. 4,00,000/- has been paid, further when the informant objected the petitioner alongwith unknown accused came and threatened and also said that matter can be amicably settled if he pays Rs. 2,00,000/-.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that from bare perusal of the allegation as alleged in the FIR, it would manifest that the dispute is purely civil, it is also submitted that the petitioner had earlier instituted complaint Case No. 253 of 2022 in the Court of learned CJM Purnea, in which cognizance was taken on 25.04.2022 and thereafter the present complaint on 26.06.2022 came to be instituted.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount
