Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 364 and 120B of the Indian Penal Code.
The prosecution case is that the brother of the informant was called and abducted by Sandeep Yadav and asked him not to vote in the election of Chairman of the Buxar Municipality.
It is submitted by the learned counsel for the petitioner that the petitioner has been made accused only on suspicion. The thrust of accusation is against Sandeep Yadav. The victim returned of his own, but has not named the petitioner. Hence, even assuming the accusation, no offence under Section 364 is made out.
Patna High Court Cr.Misc. No.54088 of 2015 (2) dt.30-11-2015 Considering the above submissions, the petitioner is accused in five other cases, this Court is not inclined to grant privilege of anticipatory bail to him. This is a case for consideration of prayer of regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Buxar (T) P.S. Case No. 316 of 2015, pending in the court of learned Chief Judicial Magistrate, Buxar.
With the above observation this application is disposed of.
