JUSTICE SUDHIR SINGH ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 341, 323, 307, 447, 353, 427, 504 of the Indian Penal Code.

Allegation against petitioner is that he along with other accused persons tried to get released co-accused Rajesh Singh from police lock-up. When they became unsuccessful, they threatened the police personnel and assaulted them by various weapons.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. General and omnibus allegation has been made. Altogether 35 persons have been named in the F.I.R. including petitioner. Other co-accused have been granted bail vide Cr. Misc. no. 32351/2016 and Cr. Misc. no. 37245 /2016. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.50852 of 2016 (2) dt.29-11-2016 2/2 above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate,-1, Siwan, in connection with Jeearadei P.S. Case no. 9 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
