JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25 (1-B)a 26/35 of the Arms Act.

Admittedly, petitioner was not caught along with F.I.R. named accused Shatrughan Kumar @ Jataha and Bharat Kumar rather, subsequently, he was arrested near a Golambar but nothing was recovered from his conscious possession. No doubt, petitioner does have criminal antecedents of four cases but it has been, specifically, pleaded in paragraph no. 3 of the petition that the petitioner has already been granted privilege of bail in all the cases.

No.24667 of 2019(2) dt.19-04-2019 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna/ concerned court in connection with Khagaul P.S. Case No. 27/19.
