Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.
The prosecution case is that the informant's daughter namely, Puja Kumari, aged about 14 years went to ease out with her cousin maternal aunt, Anita Kumari, when the petitioner came and with intention to marry abducted her. In 164 Cr.P.C. statement, the victim got her age recorded as 16 years when the learned court below assed her age as 18 years wherein she has stated that she was being kidnapped by three persons but she could not identify any one of them. It is submitted by learned counsel for the petitioner that the victim known to the petitioner but she has not named the petitioner. The court assessed the victim to be major whereas in the medical examination she was found between 16-17 years of age. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Nawada in connection with Akbarpur P.S. Case No.124 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
