The petitioner seeks pre-arrest bail in connection with Banka (Barahat) P.S. Case No.44 of 2014 registered under sections 394 and 302 of the Indian Penal Code. Regard being had to the fact that on completion of investigation, the investigating agency found the petitioner innocent and a final report was submitted against him but the learned Magistrate took cognizance of the offence and summoned the petitioner too differing with the police report, in the event of arrest or surrender in the court below within six weeks from today, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two
Patna High Court Cr.Misc. No.683 of 2016 (2) dt.12-01-2016 2/2 sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. Case No. 44 of 2014 corresponding to G.R. Case No.323 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
