The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.

It is a case of dowry death.

It is submitted that thrust of accusation is against husband of the deceased who has already been acquitted by the court below by the order passed in Sessions Trial No. 311/2022/96/2022 vide Annexure-2. Petitioner no. 1 is father-in-

Patna High Court CR. MISC. No.27082 of 2023(2) dt.07-07-2023 2/2 law, petitioner no. 2 is mother-in-law and petitioner no. 3 is brother-in-law of the deceased and they are living separately and have got no concern with the family affairs of the deceased and her husband. There is general and omnibus allegation. Petitioners bear clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Xth, Gaya in connection with Fatehpur P.S. Case No. 104 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
