JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Chhatauni P.S. Case No. 100 of 2017, registered under Sections 147, 148, 149, 341, 323, 325, 307, 447 and 379 of the Indian Penal Code.
The allegation of informant, Babita Devi, is that petitioners forming unlawful assembly armed with lathi and iron rod tried to capture her land. When she along with her three daughters, Priya, Pushpa and Priyanka reached there and made
protest then Dhirendra Singh caught her and petitioner no. 1, Ram Babu Singh, caused injury at her head through iron road. At that time, petitioner no. 2, Ashok Singh, caused fracture injury at the leg of her daughter, Priya. Thereafter, Subodh Dubey, petitioner no.5, snatched the gold chain from the neck of her daughter, Prinka and caused assault through lathi. In the meantime, petitioner no. 4, Rima Devi caused injury to her daughter Puspa.
Learned counsel for the petitioners submits that, in fact, occurrence took place due to land dispute, in which, petitioners' side also sustained injury, regarding which, Chhatauni P.S. Case No. 96 of 2017 is also instituted on the basis of written report of Rima Devi, petitioner no. 4. Moreover, the injuries as found on the person of the informant and her daughters are simple in nature.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with
Chhatauni P.S. Case No. 100 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
