The petitioner apprehends his arrest in Jalley P.S. case No. 130 of 2015 for the offences punishable under Section 420, 409, 467, 468, 471/34 of the Indian Penal Code. The petitioner is informant of the case. The petitioner, after coming to know that Ziyaul Haque, Assistant, Indira Awas, who prepared the list of beneficiaries for grant of Indira Awas, with the help of Prabhu Khatbey, illegally granted Indira Awas to nine persons, who had already been benefited under the scheme, lodged the case.
It is submitted that petitioner is not named in the FIR. Notices were issued to all nine beneficiaries and eight
Patna High Court Cr.Misc. No.5131 of 2018 (2) dt.05-02-2018 2/2 beneficiaries have already deposited the entire amount. Considering the facts aforesaid and the fact that list of beneficiaries was prepared and presented by Indira Awas Assistant, Ziyaul Haque , the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Jalley P.S. case No. 130 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
