The petitioner seeks bail in Sessions Trial No. 136 of 2019 arising out of Janta Bazar P.S. Case No. 141 of 2018, instituted for the offence under Section(s) 366A/34 of Indian Penal Code.
It is alleged in the written report that when the informant was returning to house after harvesting paddy crops she did not find her 17 years old daughter namely, Pratima Kumari, who was alone in the house. The informant and her son started making search. The informant learnt on next day that petitioner along with his family members have abducted her daughter for the purpose of marriage.
Counsel for the petitioner submits that in
Patna High Court CR. MISC. No.24968 of 2019(5) dt.10-07-2019 2/2 paragraph-27 and 28 of the case diary it has come that on 24.10.2018 the victim girl had talked with her brother and mother on Mobile phone. He further submits that petitioner has no concern with whereabouts of the daughter of the informant. He has been made accused merely on suspicion. Petitioner is in custody since 10.11.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 5th Additional Sessions Judge, Saran, in connection with Sessions Trial No. 136 of 2019 arising out of Janta Bazar P.S. Case No. 141 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
