2. The petitioner seeks bail in connection with C.R. Case No. 1688 of 2019 registered for the offences under Sections 498(A)/34 and 494 of the Indian Penal Code & Section 4 fo the Dowry Prohibition Act.
3. The petitioner is named in the F.I.R. and is in custody since 05.12.2024.
4. The allegation against the petitioner is to commit cruelty upon complainant/wife and also to solemnize his second marriage within lifetime of complainant without dissolving their marriage, in accordance with law.
5. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.24928 of 2025(3) dt.20-08-2025 2/3 petitioner submitted that complainant also solemnized her second marriage and therefore, petitioner as per mutual understanding solemnized his second marriage. It is submitted that subsequently as a matter of an afterthought present complaint was lodged by the complainant on the instance of her family members and with this allegation petitioner is in custody for about nine months. While concluding the argument it is submitted that petitioner is a man of clean antecedent.
6. Learned APP duly assisted by learned counsel for informant, opposed the prayer for bail, but fairly conceded that complainant also solemnized second marriage.
7. In view of aforesaid factual submission and by taking note of nature of accusations, coupled with the fact as petitioner remains in custody since 05.12.2024, accordingly above named petitioner, is directed to be released on bail in connection with C.R. Case No. 1688 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Samastipur/concerned court, subject to the conditions as mentioned under
Patna High Court CR. MISC. No.24928 of 2025(3) dt.20-08-2025 3/3 Section 480(3) of the B.N.S.S.
