The petitioners apprehend their arrest in Chautham P.S. Case No. 136 of 2017 registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code. The informant alleged that Ghanshyam Singh @ Dhami Singh called her daughter, but thereafter, her daughter did not return. The informant alleged that Ghanshyam Singh @ Dhami Singh and others including the petitioners kidnapped her minor daughter.

Learned counsel for the petitioners submits that the victim returned and made her statement under Section 164 of the

Patna High Court Cr.Misc. No.46299 of 2017 (2) dt.17-10-2017 Code of Criminal Procedure and she disclosed that she was not kidnapped by anyone. On being chided by her mother, she left her house.

Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Khagaria in Chautham P.S. Case No. 136 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
