02. In the present case, the petitioner seeks bail in connection with Pator P.S. Case No. 123 of 2025 registered for the alleged offences under Sections 126(2), 115(2), 109(1), 74, 352, 351(2) r/w 3(5) of Bharatiya Nyaya Sanhita, 2023.

03. As per prosecution case, the petitioner stopped the husband of the informant while he had been going to market for some urgent work and other co-accused persons assaulted him with lathi and sword at the instigation of the petitioner, causing a number of injuries to the husband of the informant.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The allegations are completely false and concocted. Land

No.25690 of 2026(2) dt.17-04-2026 2/3 dispute is apparent from the FIR itself and in the background of land dispute, the husband of the informant and others assaulted the petitioner and his wife and wife of this petitioner has lodged Pator P.S. Case No. 31 of 2025 against the informant and others. In order to put pressure upon the petitioner, this false case has been lodged. Even from the contents of the FIR, it is apparent that no specific allegation of assault has been levelled against the petitioner and only allegation is that of he is the order giver to the assailants. Learned counsel further submits that the informant has filed a complaint case bearing No. 328 of 2025 against the petitioner under Section 115(2) of BNS. The petitioner is in custody since 12.12.2025 and charge-sheet has been submitted.

05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the earlier lodged case of the petitioner's side and further considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.25690 of 2026(2) dt.17-04-2026 3/3 each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Darbhanga/court concerned in connection with Pator P.S. Case No. 123 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
