The petitioner apprehends his arrest in Bijaipur P.S. Case No. 101/2015, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act.
The informant alleged that while he along with others were working in his field all the accused persons came and asked the informant to stop the work. The informant asserted that he is the owner of the land; he would not stop the work. The co-accused ordered to kill the informant while the informant and his men were fleeing away. Amit Singh fired which caused injury to Wasim Ansari on his right leg.
Learned counsel for the petitioner submits that there is
Patna High Court Cr.Misc. No.46440 of 2016 (2) dt.30-11-2016 2/2 no allegation of assault against the petitioner. Petitioner was member of the mob and he asked the accused persons to flee from the place of occurrence. Co-accused Amit Singh who is alleged to have fired, causing fire-arm injury to Wasim Ansari has already been enlarged on anticipatory bail vide order dated 10.11.2015 passed in Cr. Misc. 52761/2015 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Gopalganj in connection with Bijaipur P.S. Case No. 101/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
