ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.02.2019 in connection with Sursand P.S. Case No. 37 of 2019 registered for the offence under Sections 30(A), 38, 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that he was merely a traveller of the tempo from which 54 liters of Nepali Saufi wine was recovered and the said vehicle belongs to one Ramekbal Sah, who has been released on bail by a Coordinate Bench of this Court vide order dated 12.04.2019 passed in Cr. Misc. No. 23606 of 2019.

Considering the aforementioned facts and

Patna High Court CR. MISC. No.25527 of 2019(2) dt.19-04-2019 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum Special Excise Act, Sitamarhi, in connection with Sursand P.S. Case No. 37 of 2019.
