ANJANA MISHRA ORAL ORDER 19-04-2019 Heard Shri Suraj Kumar Singh, Advocate holding brief on behalf of Shri Shubhesh Pandey, Advocate and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.02.2019 in connection with Barauni Rail P.S. Case No. 19 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not made from the conscious possession of the petitioner and he is being rotting in jail and the petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.25237 of 2019(2) dt.19-04-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II- cum Special Judge, Bihar Excise and Prohibition Act, Begusarai, in connection with Barauni Rail P.S. Case No. 19 of 2019.
