2. The petitioner has prayed for bail in connection with Lalganj P.S. Case No. 370 of 2025 registered for the offence punishable under Sections 329(4), 64, 308(3), 3(5) of the B.N.S., 2023.

3. The case of the prosecution, in short, is that the petitioner has established physical relationship with the informant while she was minor on the false promise of marriage. It is further alleged that on 17.07.2025, the petitioner along with his three friends arrived her house and the petitioner started establishing physical relationship whereas his other associates made video of the act. It is also alleged that the petitioner has also made threatening call to the mother of the

Patna High Court CR. MISC. No.25786 of 2026(2) dt.08-05-2026 2/3 informant and have also demanded Rs. 2 lakhs. It is further alleged that the petitioner has refused the proposal of marriage of the informant.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that from perusal of the FIR, it is clear that the petitioner and the informant were in relationship.

5. So far as the incident of 17.07.2025 is concerned, in the FIR it has been stated that the petitioner along with his three associates entered the house forcefully, whereas the victim in her statement under Section 183 of the BNSS has stated that on 17.07.2025, she had called Vicky (the petitioner) herself, and Vicky established a forceful physical relationship with her. According to the FIR, on 17.07.2025, the informant was alone, and while she was alone, she called the petitioner at her house. He further submits that the petitioner and the informant were in a relationship and as the petitioner is not ready to marry, the present case has been filed. It is a case of relationship and breakup thereafter. Moreover, a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 29.02.2026.

6. The application for bail is opposed by learned APP for the State.

7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XIII, Vaishali at Hajipur in connection with Lalganj P.S.
