1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends his arrest in connection with Madhuban P.S. Case no. 322 of 2025 registered under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 352, 351(2), 351(3) of BNS, 2023.
3. Learned counsel for the petitioner is permitted to make correction in paragraph 3 of the petition as the P.S. Case number of the present case has been stated in place of Madhuban P.S. Case No. 131 of 2014.
4. Learned counsel for the petitioner submits that it would be evident from the first information report itself that specific allegation of assaulting the informant on his head is
Patna High Court CR. MISC. No.25629 of 2026(2) dt.30-04-2026 2/3 against one co-accused Abhishek Kumar and Sandeep Kumar. So far as the petitioner is concerned there is only general and omnibus allegation of assault. Moreover, it would appear from the bail rejection order itself that all the injuries appear to be simple in nature.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. Taking into consideration the aforesaid facts and circumstances of the case and also considering the general and omnibus nature of allegation against the petitioner and the simple nature of injuries, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Madhuban P.S. Case no. 322 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/Successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
