JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-07-2024 It appears that vide order dated 20.06.2024, a report was called for from the Court below with regard to the information of the appellant Arjun Sah (Cr. Appeal (SJ) No. 154 of 2006) as his appeal was pending before this Court and no one was appearing on his behalf.

APP (SJ) No.100 of 2006(15) dt.23-07-2024 2/3 The report of learned In-charge, Fast Track Court-I, Darbhanga dated 04.07.2024 has been received which suggests that the Court concerned had directed the concerned SHO for physical appearance of appellant Arjun Sah on which the SHO, Laheriasarai, Darbhanga vide its communication dated 04.07.2024 has submitted a report wherein it has been mentioned that the appellant Arjun Sah (Cr. Appeal (SJ) No. 154 of 2006) had already died on 03.11.2023. The death certificate of the appellant Arjun Sah (Cr. Appeal (SJ) No. 154 of 2006) has been annexed with the report.

In that view of the matter, the appeal against the appellant Arjun Sah (Cr. Appeal (SJ) No. 154 of 2006) stands abated under the provisions of Section 394 of the Code of Criminal Procedure.
